Our individual property litigation team stands out from its competitors due to its depth of knowledge and experience. Even some of the junior members of our team have close to ten years’ experience and our partners considerably more.

Our individual property litigation team handles a broad range of commercial and residential real estate and private landlord and tenant disputes. Where possible the team seeks to use alternative dispute resolution mechanisms (ADR) such as mediation and arbitration and, when necessary or appropriate through the courts and tribunals.

At a glance
  • Successfully obtaining injunctive relief against a neighbouring property owner for breaches of a party wall notice.
  • Successfully acting for a residential purchaser in a claim for losses, following a misrepresentation by the seller and issues over the physical condition of the property. Successfully retrieving the purchaser’s deposit and other losses and rescinding the contract.
  • Successfully acting for a number of residential leaseholders in challenging the level of service charges claimed by the freeholder.
  • Successfully obtaining relief from forfeiture for a residential leaseholder following the service of a section 146 notice and negotiating licence terms allowing unauthorised alternations to remain in situ.
  • Successfully acting for a freeholder, who entered into a personal guarantee secured over the property, to defend possession proceedings by the charge holder.
  • Acting in a dispute between four brothers over their late father’s property. Negotiating terms for the sale of the property and the proceeds split between the parties.
