{"id":9279,"date":"2021-06-18T13:39:10","date_gmt":"2021-06-18T13:39:10","guid":{"rendered":"https:\/\/www.riaabarkergillette.com\/uk\/?p=9279"},"modified":"2025-08-06T10:08:09","modified_gmt":"2025-08-06T10:08:09","slug":"covid-safe-workplace","status":"publish","type":"post","link":"https:\/\/www.riaabarkergillette.com\/uk\/covid-safe-workplace\/","title":{"rendered":"Companies must be on track for COVID-safe workplace"},"content":{"rendered":"\n<p>Although the Government may decide that it is safe to relax regulations and recommendations around social distancing and large groups, the virus will still be circulating, and individuals could become infected or pass it on to others in the workplace.<\/p>\n\n\n\n<p>The best approach is to plan ahead and involve your staff in that process. By consulting and understanding worries around managing coronavirus, strategies can be developed, and workers can be reassured about how they will be kept safe and how, in turn, they can keep others safe.<\/p>\n\n\n\n<p>Employment lawyer <a href=\"https:\/\/www.riaabarkergillette.com\/uk\/our-team\/karen-cole\/\">Karen Cole<\/a> said:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Asking staff if they have any concerns and taking action to address those, will help to create a positive environment for people to return to work and encourage everyone to play their part in helping to operate your business safely.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>Under the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1974\/37\/contents\" target=\"_blank\" rel=\"noopener\">Health and Safety at Work Act<\/a>, employers must take steps to protect employees, whether in the workplace or acting offsite in a work capacity. All employers with five or more employees must have a written health and safety policy and make it available to employees.<\/p>\n\n\n\n<p>Karen added:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;These are statutory duties which apply whether we are in a pandemic or not. The responsibilities are even more important in the current situation, and it\u2019s sensible to take a structured approach, even if you have fewer than five staff.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>The Health and Safety Executive (<a href=\"https:\/\/www.hse.gov.uk\/\" target=\"_blank\" rel=\"noopener\">HSE<\/a>), the government body in charge of enforcing responsibilities, has developed a range of information for employers on how to make the workplace safe and protect staff as they return to the workplace.<\/p>\n\n\n\n<p>As well as ensuring staff are safe within their place of employment, staff must also be protected when travelling on business. Ignoring this aspect could expose an employer to a potential compensation claim if an employee contracts Covid-19 while travelling for work purposes.<\/p>\n\n\n\n<p>Karen explains:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;There should be a documented risk assessment for each trip, and travel options should be chosen carefully to provide the safest possible environment, such as ensuring accommodation is being thoroughly cleaned, or responding to employee concerns about using public transport.<\/p>\n<\/blockquote>\n\n\n\n<p>Employees need to have safety at the forefront of their daily activities and be aware of how they can protect themselves, their fellow workers and customers.&#8221;<\/p>\n\n\n\n<p>Mental well-being should also be high on the agenda, according to the HSE, and they have developed a <a href=\"https:\/\/www.hse.gov.uk\/stress\/assets\/docs\/stress-talking-toolkit.pdf\" target=\"_blank\" rel=\"noopener\">Talking Toolkit<\/a> as a resource for employers to handle work-related stress. Further support is available via the <a href=\"https:\/\/www.mind.org.uk\/news-campaigns\/campaigns\/mental-health-at-work-commitment\/\" target=\"_blank\" rel=\"noopener\">Mental Health at Work<\/a> charity.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-robust-health-and-safety-policies-regularly-reviewed-and-properly-implemented-are-essential-and-provide-a-strong-defence-if-anything-unfortunate-should-happen-whether-to-deal-with-coronavirus-or-otherwise-speak-to-karen-cole-today-to-review-your-health-and-safety-policy-or-to-implement-a-new-one\">Robust health and safety policies, regularly reviewed and properly implemented, are essential and provide a strong defence if anything unfortunate should happen, whether to deal with coronavirus or otherwise.
