{"id":9231,"date":"2021-05-30T12:52:24","date_gmt":"2021-05-30T12:52:24","guid":{"rendered":"https:\/\/www.riaabarkergillette.com\/uk\/?p=9231"},"modified":"2024-11-19T17:30:03","modified_gmt":"2024-11-19T17:30:03","slug":"its-a-status-thing","status":"publish","type":"post","link":"https:\/\/www.riaabarkergillette.com\/uk\/its-a-status-thing\/","title":{"rendered":"It&#8217;s a status thing!"},"content":{"rendered":"\n<p>This case highlights the importance of properly identifying the employment status of individuals to know what employment rights will apply.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-why-does-employment-status-matter\">Why does employment status matter?<\/h4>\n\n\n\n<p>The development of the gig economy, in which individuals are engaged by businesses on a flexible and ad hoc basis, has caused problems in determining employment status.<\/p>\n\n\n\n<p>In employment law, the distinction between the three categories of employment status (employee, worker and self-employed independent contractor) is significant for many reasons.<\/p>\n\n\n\n<p>Some core legal protections apply only to employees, significantly the right not to be unfairly dismissed and the right to receive a statutory redundancy payment.<\/p>\n\n\n\n<p>Workers, though, are covered by some important protections too. For instance, workers are entitled to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1998\/1833\/regulation\/13\/made\" target=\"_blank\" rel=\"noreferrer noopener\">paid annual leave<\/a> (something which is not enjoyed by the self-employed);<\/li>\n\n\n\n<li>the right to receive the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1998\/39\/section\/1\" target=\"_blank\" rel=\"noreferrer noopener\">National Minimum Wage<\/a>; and<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-uber-b-v-v-aslam-amp-others\">Uber B.V -v- Aslam &amp; Others<\/h4>\n\n\n\n<p>The key deciding factor in this decision was the degree of subordination and control that Uber drivers were subjected to.<\/p>\n\n\n\n<p>When passing judgment, Lord Leggatt stated that worker status was a question of statutory interpretation rather than contractual interpretation.<\/p>\n\n\n\n<p>This means that it does not matter what name the parties give to their working arrangement. It is the factual day-to-day practice of that arrangement which is the key to interpreting how the law will define it.<\/p>\n\n\n\n<p>Lord Leggatt surmised that the legislation is there to protect vulnerable individuals who are in a position of subordination and dependence on another person who controls their work. Therefore, where there is a greater degree of control, it is likely that the individual will be a worker rather than self-employed.<\/p>\n\n\n\n<p>The subordination and control exercised by Uber manifested itself in several ways.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>the drivers&#8217; pay was fixed by Uber and the contractual terms under which drivers performed their services was also controlled by Uber. Flagging Uber drivers as workers, as the self-employed can set their own fees and contractual terms; and<\/li>\n\n\n\n<li>once Uber drivers logged into the app, they had little choice in accepting rides. Uber could penalise drivers based on their trip cancellation rate, demonstrating the drivers&#8217; subordination to Uber.<\/li>\n<\/ol>\n\n\n\n<p>The effect of this decision and the importance placed on the purpose of the legislation demonstrates that the courts should look to protect workers, irrespective of any signed contractual documents.<\/p>\n\n\n\n<p>This emphasises the Supreme Court&#8217;s decision in <a href=\"https:\/\/www.supremecourt.uk\/cases\/docs\/uksc-2009-0198-judgment.pdf\" target=\"_blank\" rel=\"noopener\">Autoclenz Limited v Belcher<\/a>, which made clear that tribunals should look at the substance of any contract and not just its form.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><span class=\"blue-color\">&#8220;Employers would be wise to review the arrangements in place regarding their exposure to worker status claims and the financial consequences of a successful claim.&#8221;<\/span><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Many employers will state on an employment contract that an individual is self-employed for various reasons.
