{"id":5899,"date":"2019-09-20T14:02:10","date_gmt":"2019-09-20T14:02:10","guid":{"rendered":"https:\/\/www.riaabarkergillette.com\/uk\/?p=5899"},"modified":"2024-11-19T18:55:40","modified_gmt":"2024-11-19T18:55:40","slug":"dismissed-with-less-than-two-years-service","status":"publish","type":"post","link":"https:\/\/www.riaabarkergillette.com\/uk\/dismissed-with-less-than-two-years-service\/","title":{"rendered":"Dismissed with less than two years\u2019 service?"},"content":{"rendered":"\n<p>Being dismissed from your job can be a huge shock and can often feel unfair, but that doesn\u2019t necessarily mean that, in the eyes of the law, you have any claim against your previous employer. Should you find yourself in this position, you will need to consider the following:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-basis-for-challenge\">Basis for challenge<\/h4>\n\n\n\n<p>If you are dismissed for either of the following two reasons, you have the scope to challenge your dismissal.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>An automatically unfair reason for dismissal; or<\/strong><\/li>\n\n\n\n<li><strong>Discrimination.<\/strong><\/li>\n<\/ol>\n\n\n\n<p>In June, we wrote an <a href=\"https:\/\/www.riaabarkergillette.com\/uk\/automatically-unfair-reasons-dismissal\/\" target=\"_blank\" rel=\"noopener noreferrer\">article<\/a> on the unfair reasons for dismissal, listing them as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pregnancy: including all reasons relating to maternity;<\/li>\n\n\n\n<li>family reasons: including parental leave, paternity leave (birth and adoption), adoption leave or time off for dependants;<\/li>\n\n\n\n<li>representation: including acting as an employee representative;<\/li>\n\n\n\n<li>trade union membership grounds and union recognition;<\/li>\n\n\n\n<li>part-time and fixed-term employees (under the Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations 2002 and the Part-time Workers (Prevention of Less Favourable Treatment) Regulations 2000);<\/li>\n\n\n\n<li>pay and working hours: including the Working Time Regulations, annual leave and the National Minimum Wage;<\/li>\n\n\n\n<li>acting as an occupational pension scheme trustee; and<\/li>\n\n\n\n<li>whistleblowing.<\/li>\n<\/ul>\n\n\n\n<p>If you are dismissed for one of these reasons, the dismissal is unfair regardless of your length of service. You can also challenge your dismissal if it\u2019s because your employer has discriminated against you. The following protected characteristics can give rise to a discrimination claim:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Age<\/li>\n\n\n\n<li>Disability<\/li>\n\n\n\n<li>Gender reassignment<\/li>\n\n\n\n<li>Marriage or civil partnership<\/li>\n\n\n\n<li>Pregnancy and maternity<\/li>\n\n\n\n<li>Race<\/li>\n\n\n\n<li>Religion or belief<\/li>\n\n\n\n<li>Sex<\/li>\n\n\n\n<li>Sexual orientation<\/li>\n<\/ul>\n\n\n\n<p>Please note, however, if you have been dismissed when you should have been suspended on medical grounds, there is a one-month qualifying period of employment.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-appealing-your-dismissal\">Appealing your dismissal<\/h4>\n\n\n\n<p>Subject to legal advice, if your employer has dismissed you, you should first appeal under your employer\u2019s disciplinary procedure.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-contractual-claims-aka-wrongful-dismissal\">Contractual claims (aka \u201cwrongful dismissal\u201d)<\/h4>\n\n\n\n<p>If you cannot claim for unfair dismissal, you can claim for breach of contract (regardless of your length of service) if your employer hasn\u2019t complied with the terms of your employment contract. This is known as a wrongful dismissal claim.<\/p>\n\n\n\n<p>Fairness is not an issue here, and the extent of your claim will generally be limited to putting you back in the position you would have been had your employer not breached your employment contract.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-if-you-have-been-dismissed-with-or-without-two-years-service-we-strongly-recommend-taking-legal-advice-before-acting-speak-to-employment-lawyer-karen-cole-today\">If you have been dismissed with or without two years\u2019 service, we strongly recommend taking legal advice before acting.
