Special circumstances may mean an employer is obliged to provide a reference. For example, when an agreed reference forms part of the terms of a settlement agreement or employers that are regulated by the <a href=\"https:\/\/www.fca.org.uk\/\" target=\"_blank\" rel=\"noopener\">Financial Conduct Authority<\/a> or the <a href=\"https:\/\/www.bankofengland.co.uk\/prudential-regulation\" target=\"_blank\" rel=\"noopener\">Prudential Regulation Authority<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-must-a-reference-include\">What must a reference include?<\/h3>\n\n\n\n<p>The reference can include basic facts such as job descriptions, answers to questions that the potential employer has asked, and any details about the applicant\u2019s skills and abilities or strengths and weaknesses concerning the suitability of an applicant for the new role they have applied for.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-can-a-bad-reference-be-given\">Can a bad reference be given?<\/h3>\n\n\n\n<p>The reference must be \u2018accurate&#8217; and \u2018fair\u2019 and must not contain any \u2018misleading\u2019 or \u2018inaccurate\u2019 information.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-issues-can-arise-with-giving-references\">What issues can arise with giving references?<\/h3>\n\n\n\n<p>Applicants can request a copy of the reference sent to the new employer if they wish.<\/p>\n\n\n\n<p>It is usually best practice and safest for employers to have a policy about what references will cover. That way, employees know what to expect. It is generally safest to limit references to factual issues, such as the job applicant\u2019s employment dates and job description. If an employer provides a reference for some individuals but not others, it could face allegations of discrimination, victimisation, or breach of trust and confidence. Employers also need to be mindful that there is no obligation within a contract with the employee to provide a reference.<\/p>\n\n\n\n<p>Employers should record on an individual\u2019s file whether or not the employee wishes the employer to provide a reference.<\/p>\n\n\n\n<p>Suppose there is ever any doubt over whether or not an individual has given consent for an employer to give a reference.
