{"id":10566,"date":"2015-01-16T14:47:42","date_gmt":"2015-01-16T14:47:42","guid":{"rendered":"https:\/\/www.riaabarkergillette.com\/uk\/?p=419"},"modified":"2024-11-19T20:08:54","modified_gmt":"2024-11-19T20:08:54","slug":"what-happens-when-you-only-receive-part-of-an-enforcement-debt","status":"publish","type":"post","link":"https:\/\/www.riaabarkergillette.com\/uk\/what-happens-when-you-only-receive-part-of-an-enforcement-debt\/","title":{"rendered":"What happens when you only receive part of an enforcement debt?"},"content":{"rendered":"\n<p>Receiving part of an enforcement debt can occur in situations where the sale proceeds did not achieve the full amount, an offer for settlement was made and accepted by the creditor, or there is a payment by instalment arrangement agreed upon.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.legislation.gov.uk\/uksi\/2013\/1894\/contents\/made\" target=\"_blank\" rel=\"noreferrer noopener\">Taking Control of Goods Regulations 2013<\/a> have clarified the situation to work out how the part payment is allocated towards the principal sum and fees.<\/p>\n\n\n\n<p>Where goods have been sold at auction, the funds are allocated as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The auctioneer\u2019s fee.<\/li>\n\n\n\n<li>The compliance fee (currently \u00a375 plus VAT) to the enforcement officer.<\/li>\n\n\n\n<li>Allowable disbursements such as locksmiths, storage fees etc.<\/li>\n\n\n\n<li>Balance split pro rata between the judgment debt itself and the enforcement fees.<\/li>\n\n\n\n<li>When the debtor and the creditor agree on a settlement sum, the balance is split pro rata between the creditor and the enforcement fees after payment of the compliance fee.<\/li>\n<\/ul>\n\n\n\n<p>The same applies as above when there is an instalment plan agreed upon.
